Republican Circuit Judge Michael McHaney of Salem has been elected as an Appellate Court Justice on the 5th District Appellate Court in Mt. Vernon.
McHaney lost only St. Clair and Champaign County in the 48 county district on his way to receiving 66 percent of the total vote in his contest against Democrat Brian Roberts in Tuesday’s general election.
“Well I’ve always enjoyed reading and writing and that’s the main job of the Appellate Justice. Reading the record and sharing that the rules were properly followed. Evidentiary rules were followed. The process was fair to all parties. It is a perfect fit for me at this time in my career and I’m ready to make that transition.”
McHaney is appreciative of all of those who voted for him in Marion County where he beat Roberts 9,986 votes to 2,756 votes.
The unofficial vote tally was 399,690 for McHaney and 209,641 for Roberts.
McHaney says Supreme Court Justice David Overstreet will appoint a circuit court judge to replace him until an election is held to elect a new judge in the November 2024 election.
McHaney says he will be sworn in at four pm on December 1st at the Clay County Courthouse at Louisville because it is much larger than the Marion County Courtrooms.
McHaney plans to have his appellate court office in Salem.
