Several local States Attorneys are among 62 statewide who have filed a motion for declaratory judgment and injunctive relief to have the SAFE-T Act declared unconstitutional.

The State’s Attorneys signing onto the litigation include the Clinton, Jefferson, Washington, Fayette, Clay and Effingham County.    Marion County State’s Attorney Tim Hudspeth is NOT on the list.

The group argues the SAFE-T act violates the single subject rule, violates separation of powers as applied to victim rights and the bail provisions of the Illinois Constitution.   They are requesting the court to declare the law null and void.

The litigation is now consolidated in Kankakee County, with oral arguments scheduled to be heard on December 7th.  The State’s Attorneys say based upon the court order, they anticipate a ruling on December 15th.

Some of the more controversial parts of the act are scheduled to take effect January 1st, including the elimination of cash bond in many non-violent cases.
