Salem Mayor Nic Farley is sending a letter to retailers of hemp or CBD products that some will soon become illegal for them to sell.
The change takes effect on November 12th.
“Under new legislation from the Illinois General Assembly, they’re going to make hemp derivative products of over .4 milligrams of THC classified under the cannabis law and have to be sold under dispensaries. Salem doesn’t have one, so all of the products commonly referred to as Delta-8 and Delta-9 will become illegal as of November 12 under state statute. I want to make sure that all of our retailers know that that ban is coming, and we’re going to reach out to them and describe that.”
Farley says simply removing affected products from display is not sufficient if they remain in your possession with the intent to sell or deliver them without the required cannabis license.
Farley also notes this is not a blanket ban on hemp or CBD. Products that meet the new law’s limits and all applicable ingredient testing, labeling and packaging requirements may continue to be sold. He says retailers should verify compliance for each product rather than replaying solely on a ‘hemp’ or ‘CBD’ label.
Those who violate the new law could face action against their liquor or tobacco license.
