A judicial review hearing originally scheduled for Thursday on the nomination of Anthony Decker as Marion County Sheriff has been delayed until October 20th.

The delay allows attorneys on both sides to file briefs ahead of the hearing that will be conducted in Marion County Court by Judge Mark Stedelin.

The four objectors who sought the review after their objections were denied by the election board are represented by a Chicago attorney who specializes in election law.  He has to file his brief on their standing in the case by Friday.

Salem attorney Matt Wilzbach, who represents Decker, then has until next Wednesday to file his brief.

The Electoral Board also has hired an attorney.  Brian Funk of IFMK Law of Northbrook and O’Fallon also specializes in election law.

The four objectors, Precinct Committeemen Christopher Duncan, Gavin Cass, and Tracie Fisk and Republican Angela Wyatt, asked for the review because they feel the electoral board’s dismissal of their concerns over the Marion County Republican caucus was incorrect and should have been heard.

It is not clear what the end result will be if the judicial review finds Decker’s nomination was not done correctly since early voting is already underway in the election and by the October 20th hearing date, only two weeks remain before the election.
