A temporary restraining order allowing Carlyle School District students not to wear masks while inside has expired and was not extended during a Friday Clinton County Court hearing.
Judge Don Sheafor vacated the order at the request of the school’s attorney Luke Feeney, who argued the Appellate Court at Mt. Vernon had ruled in a similar Bond County case that the TRO was not valid because it only named local school officials and not the Governor, Illinois Health Department and Illinois State Board of Education.
However, the issue is not over. The attorney for the parents, Thomas DeVore, indicated he was planning to consolidate a number of lawsuits he has filed against different school districts into one Macoupin County case. DeVore says that the lawsuit will seek to do away with the mandated masks and vaccination requirements. It will name Governor Pritzker, Illinois Public Health Department, and State Board of Education as defendants as the Appellate Court said was necessary.
