Two Salem men were formally charged in Marion County Court on Tuesday in connection with an early Monday morning burglary broke up in progress at the Lucky Marble in Patoka.
38-year-old Damon Deboer and 61-year-old Harlis Atteberry of Page Road both face extended term sentences due to prior burglary convictions. Judge Ericka Sanders noted burglary charges are not a detainable offense, but she ordered both to be on GPS monitoring.
Sanders also ordered Deboer to serve a 30-day sanction for violating his pretrial release in a pending misdemeanor case. He will also be placed on GPS monitoring. Deboer was sentenced to five years in prison in November 2022 for burglary and making a false bomb threat.
Atteberry is subject to mandatory Class X sentencing due to his past convictions for burglary in Marion and Jackson Counties. Atteberry also faces misdemeanor charges of resisting or obstructing a peace officer in connection with the Monday burglary. He’s accused of running from a sheriff’s deputy trying to take him into custody.
A preliminary hearing for Deboer was set for June 18th. Atteberry will have his preliminary hearing on July 7th. Both had public defenders appointed to represent them.
