The Marion County State’s Attorney’s office charged a 33-year-old Salem man with both burglary and felony retail theft after he was allegedly found hiding in a bathroom at Farm Fresh Market in Salem after closing.

Adam Durham of West Spruce Street is believed to have hidden in the store at closing time and once everyone was gone allegedly took food from the shelves.  Police searched the building after the burglar alarm sounded and allegedly found Durham hiding in the bathroom eating some of the food.  He also reportedly had a bag of other food taken from the store sitting next to him.

During his first appearance in court Thursday afternoon Durham was released on pre-trial conditions which included no contact with Farm Fresh Market.   Durham had also been arrested on a Marion County misdemeanor failure to appear warrant in connection with another retail theft case.

A preliminary hearing was set for December fifth.
