Salem man ordered held without bond on felony domestic battery charge

A 44-year-old Salem man has been ordered without bond as his felony domestic battery case moves through Marion County Court.

Billy Smith of Bryan Street was arrested on Saturday after Salem Police received a call to the home of a female possibly being battered.  When the alleged victim answered the door a few minutes later police say she had visible injuries.   Smith was not located in the residence but was taken into custody after he reportedly came down the street yelling.  He maintained he did not cause the injuries.   Police say while on the way to the Marion County Jail, Smith allegedly made threats to ‘tear up the county’.

The domestic battery charge against Smith is a felony due to three prior convictions for domestic battery in Fayette County.

Judge Mark Stedelin cited the dangerousness standard in ordering Smith to be held without bond.  He noted the multiple threats to the alleged victim and anyone she dates, visible injuries sustained by the alleged victim, and past conduct show Smith is not likely to comply with any conditions and was on probation when the new offense occurred over the weekend.

Smith had a preliminary hearing set for May 14th.  A public defender was appointed to represent him.
