A 20-year-old Salem man has been formerly charged in Marion County Court in connection with a Monday night attack on the occupants of a vehicle traveling through Bryan Memorial Park.

Derek Murley of East Lyford was charged with two counts of aggravated battery for allegedly striking two occupants of a car that a group of people had stopped by forming a line across a park road near the bathrooms and later swarming the vehicle.  He’s also accused of two counts of mob action for allegedly acting with others in the attack.  Murley was also charged with unlawful possession of a weapon and aggravated assault for allegedly using a knife to threaten physical harm to one of the men.

Judge Mark Stedelin agreed to release Murley on pre-trial conditions over the objection of the State’s Attorney’s office.   The conditions of the release include no contact with the three occupants of the car and their families, wear a GPS bracelet for electronic monitoring, stay 200 feet away from the alleged victims homes, and stay out of Bryan Memorial Park.

Murley had a public defender appointed to represent him and is due back in court for a preliminary hearing and first appearance with counsel on June 17th.

Arrest information included in the unsuccessful attempt to hold Murley without bond indicates police have obtained a video from park cameras showing the entire incident unfold and to allow police to identify all of those who were involved.  In addition to those allegedly involved in the attack, police say two female juveniles were recording the incident.   The report also indicates that the occupants of the car asked to be allowed to pass and were able to drive a short distance before the group surrounded the car again and two of the occupants got out indicating they did not want to fight.

18-year-old Tyree Wilborn of Charleston Road in Salem was earlier ordered held without bond on aggravated battery, mob action and unlawful possession of a weapon and aggravated assault from the park incident and additional aggravated battery and mob action charges from two attacks on May 11th on the same juvenile that resulted in multiple injuries.  Wilborn was out on pretrial release in connection with a series of charges following a traffic stop by Salem Police where a gun was allegedly found in his car, he refused to get out of the vehicle and later kicked a correctional officer at the jail.

Salem Police say they have also arrested three of the juveniles believed involved in the case.   They have been released to the custody of their guardians pending further court action.    Police say they are seeking five others in the pending aggravated battery cases.
