A 26-year-old Mt. Vernon woman has been re-sentenced to 20 years in prison in Jefferson County Court on Thursday for the Class X offense of aggravated battery of a child under 13.

Abagail Adkins had her original jury trial conviction and sentence overturned by the Fifth District Appellate Court because of ineffective assistance of counsel based on defense counsel allegedly allowing Adkins to be questioned by police without her attorney being present.

Adkins will have to serve 85 percent of the sentence handed down by Judge Jerry Crisel.

Adkins along with 24-year-old Tyrone Steele were both charged with battering their infant child in 2019.  Steele was found to have committed the abuse while Atkins allegedly lied to investigators in claiming Steele did not cause the injuries.  Steele also received a 20-year prison term.
